Wrongful death suit possible in Richardson

A serious accident on the President George Bush Turnpike has left two people dead. The Texas Department of Public Safety has confirmed the fatal crash claimed the lives of a wrong-way driver and the person she struck. Authorities closed down the highway for several hours to investigate the accident. While no criminal charges are filed posthumously, the family of the other driver may choose to file a wrongful death suit in this case. 

According to police reports, around 2:30 a.m. the morning of June 27, a 22-year-old woman apparently attempted to make a U-turn on the turnpike before beginning to travel the wrong way in the westbound lanes. Officers nearby were alerted to the wrong-way driver, who they attempted to flag down as she passed them on the other side of the highway divide. Unfortunately, they were unsuccessful, and the woman struck another car head-on. 

The woman was pronounced dead at the scene, and the 53-year-old male driver she struck was rushed to a hospital in nearby Plano. He was pronounced dead of his injuries some time later. Police have not determined whether drugs or alcohol played a role in the accident, but they have not ruled out the possibility, citing it as a primary cause of wrong-way crashes.

As noted above, Texas authorities do not file posthumous criminal charges. However, if their investigation reveals the female driver to have been intoxicated or otherwise negligent in her operation of her vehicle, leading to the fatal crash, the family of the deceased man may have legal recourse available to them. A wrongful death suit filed against the woman's estate and anyone with ownership interest in the involved vehicle could result in the family being awarded damages by a civil court.
