Wrongful death possible in tragic car accident


Two teen girls from out of state were tragically killed in a hit-and-run accident about 20 miles south of Austin, according to local sources. Police in Central Texas have arrested a man seen running from the scene, as they believe he may have caused the fatal crash. Criminal charges have been filed, and state law will allow the family to sue for wrongful death in a separate civil lawsuit if they so choose. 

According to police, around 9:20 p.m. on the evening of April 27, a vehicle carrying the girls and their family was traveling on an access road off of Interstate 35. For reasons unknown, another vehicle, driven by a 61-year-old man, smashed into the family's vehicle. The force of the impact killed the two sisters, aged 16 and 18 respectively, despite both girls wearing seat belts. The other three passengers in the vehicle, a third sister, their father and a family friend, were all injured in the crash, though their conditions are currently unknown.

The driver of the other vehicle reportedly fled the scene on foot, but was caught by police shortly thereafter. He is charged with two counts of accident causing death and three further counts of accident causing serious injury. He is being held at a county jail against $450,000 bail pending further legal proceedings.

Regardless of the charges filed against the other driver, a civil route remains open to the victimized family. They can choose to file wrongful death lawsuits against him on behalf of their deceased relatives, as well as personal injury suits for those who survived the crash. A Texas civil court will likely consider police evidence of wrongdoing on the part of the driver being sued.
